Welcome to RAMON NIEVES ART LLC. These Terms of Service outline the policies and conditions governing tattoo consultations, appointment bookings, deposits, payments, cancellations, rescheduling, and tattoo services provided by Ramón Nieves.

We encourage all clients to carefully review these terms before confirming an appointment or submitting a booking deposit.

By expressly accepting these Terms of Service during the booking process, clients acknowledge that they have read, understood, and agreed to the conditions outlined below, subject to applicable law.

1. Appointment Booking & Reservations

All tattoo appointments are scheduled in advance and are subject to availability.

A $500 non-refundable booking deposit is required to secure an appointment.

This deposit reserves dedicated time in Ramón Nieves' schedule and supports the administrative coordination and preparation associated with each tattoo project.

The deposit is credited toward the cost of the client's final tattoo session.

An appointment is considered confirmed only after the required deposit has been received and an official booking confirmation has been issued by the studio.

2. Booking Deposits & Refund Policy

All booking deposits are non-refundable, except where otherwise required by applicable law or expressly provided in these Terms of Service.

By submitting a deposit after accepting these terms, the client acknowledges the studio's booking, cancellation, and rescheduling conditions.

Deposits may be forfeited in cases of client-initiated cancellation, failure to attend a scheduled appointment, or failure to comply with the rescheduling requirements outlined below.

The studio reserves dedicated appointment time for each confirmed booking, which may limit availability for other clients.

3. Cancellation & Rescheduling Policy

We understand that unexpected circumstances may arise. However, clients are required to provide at least 48 hours' notice when requesting to reschedule an appointment.

Each booking is eligible for one rescheduling only, subject to availability.

Requests made with less than 48 hours' notice, as well as requests for a second rescheduling, will result in forfeiture of the original $500 deposit, to the extent permitted by applicable law.

A new $500 non-refundable deposit will be required to secure another appointment.

Clients who cancel their appointments or fail to attend without prior notice will forfeit their booking deposit, subject to applicable law.

Exceptional Circumstances

We recognize that certain unforeseen or exceptional circumstances may require special consideration.

RAMON NIEVES ART LLC may evaluate individual situations and determine whether an exception to the standard cancellation or rescheduling policy is appropriate.

Any discretionary exception must be reviewed and approved by Ramón Nieves or authorized studio personnel on a case-by-case basis.

Exceptions are not guaranteed, and granting an exception in one situation does not establish an obligation to grant similar exceptions in the future.

All decisions remain subject to applicable law and will be made without unlawful discrimination.

4. Studio-Initiated Cancellations & Rescheduling

RAMON NIEVES ART LLC is committed to honoring all confirmed appointments.

In rare circumstances involving illness, emergencies, unforeseen events, or situations beyond our reasonable control, the studio may need to cancel or reschedule an appointment.

Should this occur, we will notify the client as soon as reasonably possible and offer alternative appointment dates, subject to availability.

Any existing booking deposit will remain valid and will be applied toward the rescheduled appointment.

Studio-initiated changes will not count toward the client's one-time rescheduling allowance.

If a mutually acceptable alternative date cannot be arranged, the client's $500 booking deposit will be fully refunded.

Travel, Accommodation & Additional Expenses

Clients are solely responsible for arranging and covering their own travel, accommodation, transportation, meals, and any other personal expenses associated with their tattoo appointments.

To the fullest extent permitted by applicable law, RAMON NIEVES ART LLC is not responsible for reimbursing or compensating clients for travel-related expenses, including airfare, hotel reservations, transportation costs, cancellation fees, lost wages, or other incidental or consequential expenses arising from appointment cancellations, rescheduling, or unforeseen circumstances.

Clients traveling from outside the area are encouraged to consider flexible or refundable travel arrangements.

Nothing in this section excludes liability that cannot legally be limited or waived.

5. Tattoo Pricing & Payment Terms

Tattoo pricing is determined by the nature, size, complexity, placement, and estimated time required for each project.

Session estimates are provided in good faith and are not guarantees of the exact number of sessions required to complete a tattoo.

Projects requiring multiple sessions may involve additional appointments and corresponding session charges.

Clients are responsible for paying the agreed amount for tattoo services performed.

Payments may be processed through accepted payment methods, including Stripe, SwipeSimple, and Zelle.

Any additional charges or changes to the agreed scope of work will be communicated to the client before the corresponding services are performed.

6. Tattoo Services & No-Refund Policy

Payments for tattoo services already performed are final and non-refundable, except where otherwise required by applicable law.

Tattooing is a permanent, personalized artistic service.

Clients acknowledge that subjective dissatisfaction with previously reviewed and approved artistic elements, or a subsequent change in personal preferences, does not by itself entitle them to a refund.

Clients are responsible for reviewing and approving the final tattoo design, placement, approximate size, and agreed pricing before the procedure begins.

This policy does not eliminate any legal rights or remedies that cannot lawfully be waived.

7. Artistic Direction & Creative Freedom

Ramón Nieves specializes in custom tattoo artwork developed through his artistic vision, experience, and professional judgment.

Reference images, inspiration materials, and initial concepts are used as starting points rather than exact reproductions.

Clients understand that designs may be artistically reinterpreted to achieve appropriate composition, anatomical flow, contrast, and visual longevity.

Trust in the artist's creative direction is an essential part of the custom tattoo process.

Clients will have the opportunity to review and approve the final design and placement before the tattoo procedure begins.

8. Design Approval & Client Acknowledgment

Before the tattoo procedure begins, clients must review and approve the agreed design, placement, approximate size, and pricing.

Approval is documented through the studio's consultation and consent procedures.

Clients acknowledge that tattoos are permanent and that the final healed appearance may vary depending on individual skin characteristics, healing responses, and other factors.

Approval of the design does not eliminate any rights or remedies that cannot legally be waived.

9. Client Eligibility & Responsibilities

Clients must be at least 18 years old and provide valid identification when requested.

All clients must complete and sign the required Tattoo Procedure Waiver before receiving tattoo services.

Clients are responsible for providing accurate information relevant to the safety of the procedure, including applicable health conditions, allergies, medications, and skin concerns.

Clients are expected to follow the aftercare instructions provided by the studio.

RAMON NIEVES ART LLC may decline or postpone a procedure when necessary to address safety, consent, or other legitimate concerns, subject to applicable law.

10. Tattoo Procedure Waiver & Informed Consent

All clients must complete and sign the studio's Tattoo Procedure Waiver before receiving tattoo services.

The waiver addresses procedural risks, informed consent, relevant health disclosures, design approval, and applicable liability provisions.

These Terms of Service govern the commercial aspects of booking and tattoo services.

The Tattoo Procedure Waiver separately governs informed consent and acknowledgment of procedural risks.

Nothing in these Terms of Service limits liability that cannot legally be excluded.

11. Tattoo Photography & Promotional Use

Photography and documentation of completed and in-progress tattoo artwork are an important part of Ramón Nieves' professional portfolio and artistic practice.

RAMON NIEVES ART LLC may photograph and record tattoo artwork for documentation, portfolio development, social media, website content, advertising, and other legitimate promotional purposes.

Where the client has provided express authorization through the studio's photography consent process, RAMON NIEVES ART LLC may reproduce, edit, display, and publish photographs or videos of the tattoo artwork across its promotional channels without requesting separate approval for each publication.

Such authorization applies to the tattoo artwork and does not independently authorize disclosure of the client's identity or confidential personal information.

Client Privacy & Personal Information

RAMON NIEVES ART LLC will not intentionally disclose a client's name, contact information, medical information, or other confidential personal details for promotional purposes without appropriate consent.

Photographs or videos that clearly identify a client, including recognizable facial features, will require separate authorization before publication.

The studio will take reasonable steps to protect client privacy when sharing tattoo-related content.

The collection, use, and retention of photographs and personal information are further addressed in the studio's Privacy Policy.

12. Payment Disputes & Client Concerns

Clients are encouraged to contact RAMON NIEVES ART LLC regarding questions or concerns about their appointments, payments, or tattoo services.

The studio may review relevant booking confirmations, payment records, communications, design approvals, and signed consent documentation when responding to a payment dispute.

Nothing in these Terms restricts a client's legally protected right to dispute a payment or pursue an available legal remedy.

13. Privacy & Personal Information

Personal information is handled in accordance with the studio's Privacy Policy.

Information collected through booking forms, consent documentation, communications, and payment systems is used for legitimate business and service-related purposes as described in that policy.

14. Governing Law & Severability

These Terms of Service shall be governed by the laws of the State of North Carolina, except where other applicable law requires otherwise.

If any provision is found invalid or unenforceable, the remaining provisions shall continue in effect to the extent permitted by law.

15. Changes to These Terms

RAMON NIEVES ART LLC may update these Terms of Service periodically to reflect changes in business practices, services, or applicable legal requirements.

Updated terms will be published on the studio's website with a revised effective date.

Changes will not retroactively alter the terms of an existing confirmed booking without the client's agreement, except where required by law.
